Agreement to Terms

These Terms of Service ("Terms") govern your use of services provided by Mission Beach Adventures ("we", "us", "our"), operating from Clump Point Jetty, Mission Beach QLD 4852.

By making a booking, submitting an enquiry, or participating in any of our tours or activities, you confirm that you have read, understood, and agree to be bound by these Terms. If you are booking on behalf of other participants, you accept these Terms on their behalf.

These Terms form a legally binding agreement. Please read them carefully before confirming your booking. If you have any questions, contact us before proceeding.

Booking Conditions

All bookings are subject to availability and are only confirmed upon receipt of a deposit or full payment as specified at the time of booking.

  • Booking enquiries: Submitting a booking enquiry form does not constitute a confirmed booking. A booking is only confirmed when you receive written confirmation from us via email.
  • Participant numbers: We reserve the right to cancel or reschedule tours that do not meet our minimum participant requirements. You will be offered a full refund or alternative date in such cases.
  • Accuracy of information: You are responsible for providing accurate participant details including names, ages, fitness level and any relevant medical conditions at the time of booking.
  • Group bookings: Private charter and group bookings may be subject to additional terms and a separate booking agreement. Contact us to discuss your requirements.

Payment & Pricing

All prices are displayed in Australian Dollars (AUD) and include GST where applicable. Prices are subject to change without notice until a booking is confirmed.

Deposits
A deposit may be required to secure your booking. The deposit amount will be advised at the time of booking.
Full payment
Full payment is required prior to departure unless alternative arrangements have been agreed in writing.
Secure processing
Payments are processed securely via third-party providers. We do not store your card details.
Price changes
Once a booking is confirmed, your quoted price is locked in regardless of any subsequent price changes.

Cancellation & Refund Policy

We understand plans can change. Our cancellation policy is designed to be fair while reflecting the costs we incur when preparing for your tour.

  • All cancellation requests must be submitted in writing to tours@missionbeachadventures.com.au.
  • Refunds will be processed within 7 business days via the original payment method.
  • Rescheduling to another available date is free of charge with more than 72 hours notice.
  • We strongly recommend travel insurance that covers tour cancellations.

Weather & Safety Cancellations

We operate in a tropical marine environment. The safety of our guests and crew is our highest priority. We reserve the right to cancel, modify or delay any tour at any time due to:

  • Adverse weather: High winds, rough seas, tropical storms or cyclone warnings
  • Mechanical issues: Vessel maintenance requirements or unexpected equipment failure
  • Regulatory directives: Marine safety authority or local government directives
  • Skipper discretion: Any other condition the skipper reasonably considers unsafe

Weather cancellations by us: You will be offered a full refund or a complimentary reschedule to an alternative date — whichever you prefer. We do not charge any cancellation fee when we cancel due to weather or safety reasons.

Liability Waiver

Participation in water-based adventure activities involves inherent risks. By booking with us, you acknowledge and accept the following:

  • Water-based activities carry inherent risks including, but not limited to, sea conditions, marine life, falls overboard, and physical exertion.
  • Mission Beach Adventures, its operators, employees, contractors and agents accept no liability for any loss, damage, injury or death arising from participation in our tours, except to the extent caused by our gross negligence or wilful misconduct.
  • You participate at your own risk and are responsible for your own safety at all times.
  • Nothing in these Terms limits any rights you have under the Australian Consumer Law that cannot be excluded by contract.

We strongly recommend all guests obtain appropriate travel and personal accident insurance prior to departure. We do not provide personal accident or medical insurance on your behalf.

Guest Responsibilities

As a guest, you agree to:

Arrive on time
Be at the departure point at least 15 minutes before the scheduled departure time. Late arrivals may not be accommodated.
Disclose health conditions
Inform us before booking of any medical conditions, disabilities or pregnancy that may affect your ability to participate.
Follow crew instructions
Comply at all times with safety briefings and instructions from our skipper and crew. Failure to comply may result in removal from the tour without refund.
Respect the environment
No touching or taking of coral, marine life or reef material. No littering. We operate in protected marine park areas.
No intoxication
Guests who appear to be under the influence of alcohol or drugs at departure will be refused participation and no refund will be given.
Respect others
Behave respectfully toward other guests and crew at all times. Abusive or threatening behaviour will not be tolerated.

Health & Fitness Requirements

Some of our activities have minimum fitness or health requirements for participant safety. Guests should be in reasonable health and physical fitness to participate in water-based activities.

  • Pregnancy: Guests who are pregnant are advised to seek medical clearance before booking water activities and must disclose their condition at the time of booking.
  • Medical conditions: Guests with heart conditions, back or neck injuries, epilepsy, or other conditions affected by water activities should consult their doctor prior to booking.
  • Swimming ability: For snorkelling tours, guests are required to be comfortable in open water. Flotation devices are available but cannot substitute for basic water confidence.
  • Age requirements: Minimum age requirements vary by activity and are listed on each tour page. All children under 16 must be accompanied by a parent or legal guardian.

We reserve the right to refuse participation to any guest whose health or fitness may place themselves or others at risk. In such cases, our standard cancellation policy applies.

Personal Property & Photography

We are not responsible for loss, theft or damage to personal property, including cameras, phones, jewellery or other valuables brought on board. We strongly advise leaving valuables securely stored ashore.

  • Waterproof cases and lanyards are strongly recommended for cameras and phones.
  • We may take photographs or video during tours for promotional purposes. Please inform us before departure if you do not consent to being photographed.
  • You grant us permission to use any images or video you voluntarily share with us (e.g. tagged on social media) for promotional purposes.

Governing Law & Disputes

These Terms are governed by the laws of Queensland, Australia. Any dispute arising from these Terms or your use of our services will be subject to the exclusive jurisdiction of the courts of Queensland.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted or modified by agreement.

If you have a complaint or dispute, please contact us in the first instance. We are committed to resolving any issues promptly and fairly.

Changes to These Terms

We reserve the right to update these Terms at any time. The current version will always be published on this page with the "Last Updated" date shown at the top.

Any changes take effect immediately upon publication. Bookings made before the change will be governed by the Terms in force at the time of booking, unless we notify you otherwise.

Continued use of our services after any changes constitutes your acceptance of the updated Terms.
